These Terms of Service (“Terms”) are a binding agreement between you (“User”) and InvestingWars Inc. (“Company”).
BY USING THE PLATFORM, YOU AGREE TO THESE TERMS.
YOU ACKNOWLEDGE:
- Markets are volatile and unpredictable
- Simulated results do not predict real performance
- Competitions involve uncertainty
- You participate voluntarily
YOU ASSUME ALL RISKS.
The Platform:
- Is a simulation using virtual funds
- Does not execute real securities trades
- Is educational and entertainment-oriented
The Company is NOT:
- A broker-dealer
- An investment advisor
- A securities exchange
- A bank
- A money transmitter
- A gambling operator
Nothing herein creates a financial advisory or fiduciary relationship.
No content constitutes:
- Investment advice
- Financial advice
- Tax advice
- Legal advice
Users bear sole responsibility for real-world decisions.
Competitions are skill-based.
Entry fees compensate for:
- Platform access
- Technology services
- Administration
- Prize pools
Users acknowledge skill contests still involve uncertainty.
The Company operates a simulation and competition platform only and does not hold customer funds for investment or trading.
To the extent payments or prizes are processed:
- Licensed third-party payment providers are used
- Funds transmission (if any) is handled by regulated entities
- The Company does not provide custody services for securities
The Company may implement controls consistent with:
- Anti-Money Laundering (AML) laws
- Counter-Terrorist Financing (CTF) laws
- Sanctions regulations
- Fraud prevention laws
Users agree to cooperate with reasonable compliance requests.
The Company may require:
- Identity verification
- Age verification
- Address confirmation
- Source-of-funds inquiry for prize payouts
Failure to comply may result in suspension or forfeiture.
Users represent they are not:
- Sanctioned individuals
- Located in comprehensively sanctioned jurisdictions
- Acting on behalf of prohibited parties
The Company may screen users against sanctions lists.
The Company may at any time:
- Modify competitions
- Cancel events
- Adjust scoring
- Withhold prizes
- Limit access
- Suspend or terminate accounts
At sole discretion for risk, compliance, or integrity reasons.
All fees:
- Are non-refundable
- Do not guarantee winnings
- Are earned upon payment
- Chargebacks may result in bans
Prizes:
- Are conditional and revocable
- Subject to compliance checks
- May require tax reporting documents
- May be delayed for verification
- Users are responsible for taxes
Users shall not:
- Cheat or exploit bugs
- Use bots
- Reverse engineer
- Manipulate competitions
- Collude
- Attempt fraud
We may investigate and act unilaterally.
All Platform IP belongs to the Company. Users receive a limited, revocable license.
THE PLATFORM IS PROVIDED:
- “AS IS”
- “AS AVAILABLE”
- “WITH ALL FAULTS”
We disclaim all warranties.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
The Company and its leadership are not liable for:
- Financial losses
- Lost profits
- Data loss
- Service interruptions
- Security incidents
- Third-party failures
- Competition outcomes
- Loss of virtual currency
- Inability to access the Platform
- Indirect or consequential damages
TOTAL LIABILITY CAP = GREATER OF:
- $100 USD
- Fees paid in prior 12 months
Users indemnify the Company from claims arising from:
- Misconduct
- Legal violations
- Breach of Terms
- Fraud or abuse
Survives termination.
Users waive:
- Jury trials
- Class actions
- Collective claims
Binding arbitration in Nebraska.
Access may be terminated anytime without notice.
No liability for:
- Regulatory changes
- Market disruptions
- Cyberattacks
- Infrastructure failures
- Natural disasters
Governed by laws of Nebraska.
- Must be 13+ to play
- Must be 18+ to enter prize competitions
- Not available where prohibited by law
- We may require age or identity verification for prize eligibility
You agree to:
- Provide accurate information
- Maintain one account
- Not impersonate others
- Not attempt to manipulate gameplay or rankings
We may suspend or terminate accounts for violations.
- Portfolio performance is based on real market data, but all trades are simulated
- Leaderboards, scoring, and rewards are determined by published rules
- We may adjust scoring or correct errors at any time
- Virtual currency has no monetary value
- It cannot be sold, transferred, or exchanged for real money
We may update these Terms. Continued use constitutes acceptance.
Game Disclaimers
This Game:
- Does not involve real money
- Does not allow wagering
- Does not award cash prizes unless explicitly stated
- Is skill-based, not chance-based
The Game:
- Is not financial advice
- Does not provide investment recommendations
- Should not be used to make real-world financial decisions
Market data may be:
- Delayed
- Inaccurate
- Incomplete
We do not guarantee accuracy.
Safety & Conduct Policy
Players must:
- Treat others respectfully
- Avoid harassment or hate speech
- Avoid cheating or exploiting bugs
Users may report:
- Abuse
- Cheating
- Security issues
We may:
- Issue warnings
- Reset scores
- Suspend accounts
- Permanently ban violators
Prize Rules & Eligibility
- Must be 18+
- Must reside in an eligible region
- Must comply with identity verification
- Gift cards
- Merchandise
- Digital rewards
- Cash prizes (optional, if the Company chooses to offer them)
- Based on leaderboard performance
- Ties resolved by predefined tie-breakers
- Cheating results in disqualification
Winners are responsible for any applicable taxes.
